1.1 We Are NOT Affiliated With "aesoftech.com" or Any Other "DaVinci Deluxe" — No Refund for Brand Confusion

This website (davincideluxe.fr) and our product, DaVinci Deluxe · Cloud Edition, have NO relationship, affiliation, partnership or connection whatsoever with "aesoftech.com", "AE Softtech", or any other company or website that sells a product called "DaVinci Deluxe" or anything similar. They are a completely different, unrelated company. Their software, their user interface, their branding and their logo are entirely different from ours.

Our official product is DaVinci Deluxe · Cloud Edition — sold ONLY here at davincideluxe.fr, with our own distinct colored logo, our own Cloud Edition interface, our own website and our own payment system (Stripe). The interface, the design, the logo, the features — everything is different from any other "DaVinci Deluxe" you may find elsewhere.

If you paid a different company (for example aesoftech.com, AE Softtech, a reseller, a forum, or any third party) and then claim you were "looking for DaVinci Deluxe" or that you "confused" their product with our Cloud Edition, this is NOT a valid ground for any refund from us. We can only see, activate, support or refund payments made to US, on this site. A payment made to another company is that other company's responsibility — contact them. We have no access to their systems, their orders or their money, and we owe nothing on the basis of a confusion between two unrelated products.

NO MONEY IS EVER REFUNDED. NEVER. Every product and service we sell is FINAL. All sales are final — there are no refunds, no returns, no exchanges and no cancellations, under any circumstances. By purchasing on davincideluxe.fr you confirm you understand that you are buying DaVinci Deluxe · Cloud Edition from us, that it is a distinct product with its own colored logo and interface unrelated to any other "DaVinci Deluxe", and that all sales are strictly final and non-refundable.

1.2 Situations That Are NEVER a Ground for a Refund

To leave no room for doubt, the following are explicitly NOT valid reasons for any refund, partial refund, chargeback or dispute. In every case below, all sales remain strictly final:

• "It did not work" / "I did not like the result" / dissatisfaction. DaVinci Deluxe · Cloud Edition is a professional tool. The tuning result depends on your vehicle, your ECU, your file, your setup and how you use the software — factors outside our control. Subjective dissatisfaction, a result that did not meet your personal expectation, or a claim that "it did not work" after the software was delivered and used is NOT a ground for a refund. Unsuccessful automated patches on esoteric or already-modified files are normal in this industry (see Section 2) and, where a delivered file genuinely fails, the remedy is a PAID 'Real Software Test' for 9.99 € — never money back.

• Change of mind / right of withdrawal. "I changed my mind", "I no longer need it", "I bought the wrong plan", "I bought by mistake" are NOT refundable. Because this is digital content and a digital service supplied immediately, you expressly request immediate performance and delivery at purchase and thereby waive any statutory right of withdrawal / cooling-off period (including the EU 14-day right) the moment the software is activated, downloaded, or a token/credit is used, to the fullest extent permitted by applicable law.
• Forgot to cancel / "I did not know it renews". Monthly and Annual plans renew automatically. The auto-renewal is disclosed at checkout, in your profile, and a reminder email is sent before renewal. Forgetting to cancel, not noticing a renewal, or an unused period after a renewal is NOT a ground for a refund. You may cancel at any time from your profile to stop future renewals — but an already-charged period is never refunded.
• Bought from a third party / reseller / forum / "someone sold it to me". The ONLY official source of a DaVinci Deluxe · Cloud Edition license is davincideluxe.fr. Licenses, keys, accounts or "lifetime" copies obtained from a reseller, a forum, a marketplace, a group buy, or any third party are unauthorized: we cannot see, verify, activate, support, transfer or refund them, and a payment you made to a third party is that third party's responsibility, not ours. A license bought as, or given as, a gift is subject to these same non-refundable terms.
• A specific service is greyed out, or your exact ECU / software version is not covered yet. DaVinci Deluxe · Cloud Edition is a professional platform that works on thousands of ECUs, vehicles and services. The fact that one specific service is greyed out in the app, or your one exact ECU software version is not in our database yet, is NOT a fault, NOT a failure to deliver, and NOT a ground for any refund. A greyed-out button means that service is "available on request" for that exact unit — tap it, send us the original virgin read, and we add coverage for your ECU and notify you here; your credits are never spent on a service that is unavailable (they stay in your account). You bought a tool that performs a huge range of work; the absence of one specific service or one specific software variant — out of the many thousands supported — does not entitle you to a refund. Before buying, you can confirm your exact ECU with the supported-list PDF, the paid 'Real Software Test', or by asking us here.
• A damaged ECU, a car that will not start, or a vehicle in fault/limp mode after flashing. ECU tuning is an inherently risky activity carried out entirely by you, the professional user, on your own equipment and responsibility. A mandatory ORIGINAL backup, the virgin-files-only rule, and the risk of ECU damage ("bricking") — including when clone/counterfeit flashing hardware is used — are disclosed in advance (see /ecu-brick-risk.html, linked in the footer) and accepted at purchase. A bricked or non-starting ECU, a failed write, or a car in limp mode is an accepted, disclosed risk of the activity itself and is NOT a defect of our software or a ground for any refund, partial refund or chargeback. Where a file WE delivered genuinely fails, the remedy is to re-flash your original backup and use "Report a Problem" for a PAID 'Real Software Test' — never money back. We are not liable for damage caused by your hardware, your reading tool, an interrupted flash, a non-virgin file, or misuse.
• Emissions legality, roadworthiness test (TÜV / MOT / ITV / inspection), or a fine. Services such as DPF, EGR, AdBlue/SCR and DTC removal are provided as an off-road / motorsport / diagnostic tool. Ensuring that any modification is legal in your country and for your intended use is entirely YOUR responsibility as the professional operator. Failing a roadworthiness/emissions inspection, being fined, or a vehicle no longer being road-legal after a modification is a consequence of how YOU choose to use the tool — it is NOT a fault of the software and NOT a ground for any refund, and does not create any liability on our side.
• "I did not know it needs internet" / no connection at the workshop PC. DaVinci Deluxe · Cloud Edition is a cloud service that processes your files on our servers, so a permanent internet connection is required — this is disclosed on the pricing page, at checkout, and in the installation requirements before purchase. A workshop or garage PC with no internet, or discovering after purchase that your machine cannot connect, is NOT a fault of the product and NOT a ground for a refund. Use a phone hotspot or any internet connection; there is no offline mode.
• Processing time, queue position, or the 10-minute trial running out. Cloud processing times, daily file limits, queue position at busy times, and the duration of the paid 'Real Software Test' are normal, expected characteristics of the service, disclosed in advance. A job taking some time to process, waiting in the queue, or the 'Real Software Test' reaching its time limit before you finished are NOT faults and NOT grounds for a refund. If a job genuinely cannot be processed (ECU not in our catalogue), it is rejected with a clear reason and no credits are charged — that is the remedy, not a refund.
• Not wanting to pay the €50 PC-change / HWID-change fee. Every license is bound to ONE computer (HWID). Moving your license to a different or new PC — including when your old PC was sold, replaced, reinstalled, or destroyed — costs a one-time €50 fee. This fee is real, it is paid, and it is NOT optional or free. This condition is disclosed on the pricing page, at the secure checkout, and in this policy before purchase. Nothing said in chat entitles you to a refund that this policy does not grant.

By purchasing, subscribing or activating DaVinci Deluxe · Cloud Edition you confirm you have read and accept this section, that these situations are not grounds for a refund, and that opening a chargeback or dispute on any of them is a breach of these Terms (see Sections 1 and 1.3).

1.5 Abusive Conduct, Threats & Retaliatory Disputes

We treat every customer with respect and expect the same in return. Insults, threats, harassment, or blackmail (for example, threatening a chargeback, a payment dispute, or a negative review in order to obtain a refund or a free service) are a serious violation of these Terms.

All support conversations are recorded. A customer who insults, threatens or attempts to blackmail our automated support or our team receives a recorded warning; repeated abusive conduct results in a permanent ban from all DaVinci Deluxe · Cloud Edition services, with no refund of any kind, and the loss of any tokens, credits or licenses on the account.

Payment disputes opened as retaliation will be contested. Where a chargeback or payment dispute is opened by a customer whose access was terminated for abusive conduct, we submit to the payment processor the full recorded history of that customer's messages (including the insulting, threatening or blackmailing content) together with proof of product delivery and usage, as evidence that the dispute is retaliatory rather than a genuine service failure. Opening a fraudulent or retaliatory chargeback on a delivered digital product is itself a breach of these Terms.

⚠️ 2.1 Heavy-Duty Trucks — Beta Coverage: Verify Your ECU Before Buying (No Refund for Unverified Purchases)

DaVinci Deluxe · Cloud Edition is designed for passenger cars and light commercial vans, with heavy-duty truck coverage in beta (expanding gradually) (e.g. Sprinter, Transit, Ducato, Vivaro, Iveco Daily, Master, Boxer, Trafic, NV200/400). The supported ECU list (publicly published at DaVinci_Deluxe_Supported_List.pdf?v=1043) and our pricing page state this scope explicitly before purchase.

The following heavy-duty / commercial truck and off-highway segments are NOT supported, have never been advertised as supported, and are explicitly excluded from any refund eligibility:

• Volvo Trucks — FH, FM, FMX, FE, FL series; engines D11, D13, D16
• DAF — XF, CF, LF series; PACCAR MX-11/MX-13 engines
• Scania — R, S, G, P series; engines DC09, DC13, DC16
• MAN — TGX, TGS, TGM, TGL; engines D2066, D2676, D3876
• Iveco Stralis / S-Way / Eurocargo / Trakker (Iveco Daily LCV IS supported)

No-refund policy for HD truck mistakes: Purchasing DaVinci Deluxe · Cloud Edition to attempt work on any of the above is the customer's sole responsibility. Coverage scope is disclosed (a) on the pricing page, (b) on the checkout interstitial page, (c) on the publicly available supported list PDF, and (d) in this policy. Buying the license and afterwards discovering the truck or off-highway engine is not in the catalog does NOT constitute a valid refund ground, nor a basis for chargeback or dispute. By completing checkout you confirm you have read these disclosures and accept this exclusion.

🔒 2.2 HWID Freeze on Cancellation — Multi-Account Abuse is Forbidden

Each DaVinci Deluxe · Cloud Edition license is bound to one or more physical computers via a Hardware ID (HWID) generated by the desktop launcher (a SHA-256 hash of stable hardware and system identifiers). This binding is permanent and serves as both license enforcement and anti-piracy protection.

At the moment your subscription is cancelled (by you, by us, or via Stripe payment failure), the following automatic actions take place:

• All HWIDs currently bound to your account are copied to our frozen_hwids registry and locked to your user_id.
• You can NO LONGER remove, reset, or transfer your HWIDs from /profile or via any API endpoint.
• Any new DaVinci Deluxe · Cloud Edition account created with the same physical computer will be blocked at login: the software will refuse to start and the new account will be flagged as multi-account abuse.

The only legitimate way to reuse a frozen HWID is to re-subscribe with your original email. Re-subscribing reactivates your previous HWID(s) automatically.

No-refund policy for HWID-freeze circumvention: Creating a second DaVinci account in an attempt to bypass the HWID freeze is considered multi-account abuse and fraud. If detected, we will (a) ban the new account, (b) freeze all HWIDs of the new account too, (c) report the fingerprint pattern to Cloudflare for edge-level blocking, and (d) refuse any refund request related to either the original or the new account, including chargeback disputes. Stripe / Cloudflare / Telegram alerts log the attempt with timestamp and IP, providing the evidence we use to contest any reverse-payment claim with your bank.

By purchasing, subscribing, or activating DaVinci Deluxe · Cloud Edition you confirm you have read this HWID freeze policy and agree that any attempt to circumvent it forfeits your right to refund, partial refund, or chargeback. The disclosure is logged on (a) this policy page, (b) the /profile cancellation box shown before any cancel action, (c) the Stripe checkout interstitial, and (d) the refund policy at the time of purchase.

🖥️ 2.3 One Computer Per License · No Remote Desktop (RDP) · PC-Change Fee

Each DaVinci Deluxe · Cloud Edition license is for use on one (1) physical computer that you own and operate directly. This is a core condition of every purchase and subscription.

• Remote Desktop is not permitted. The software will not run over Remote Desktop (RDP), Terminal Services, Windows Server or any remote / virtual session — it detects the remote session and refuses to start. This prevents account sharing and protects your license; it is intended behaviour, not a bug or defect.
• One PC only. Once your license is activated (HWID-bound) on a computer it is tied to that machine. You cannot use the software on a second / different computer under the same license without an authorized PC change.
• Moving to a different physical PC costs a €50 HWID-change fee (for a genuine hardware change or a new computer). Reinstalling or updating the app on the same machine (without formatting or reinstalling Windows) is free — that is a false trigger and we reset it at no charge. Formatting the PC or reinstalling the operating system changes the HWID and counts as a PC change, so the one-time €50 HWID-change fee applies.

By purchasing, subscribing or activating DaVinci Deluxe · Cloud Edition you confirm you have read and accept that (a) Remote Desktop / remote sessions are blocked, (b) the license is limited to one computer, and (c) a €50 fee applies to move to a different physical PC. These conditions are disclosed on this policy page and at the secure Stripe checkout, and no refund, partial refund or chargeback will be granted for a purchase where the software was used, or attempted to be used, over Remote Desktop or on a second computer without a paid HWID change.
